Supreme Court Advises Filing of Damages Suit in Covishield Vaccine Disability Case

Recently, Supreme Court has advised a petitioner who allegedly suffered 100% permanent disability in his legs following a Covishield COVID-19 vaccination to file a civil suit for damages instead of continuing with his current petition.

The bench, comprising Justices B.R. Gavai and Augustine George Masih, addressed the issue of Adverse Events Following Immunization (AEFI) and emphasized the importance of adhering to proper guidelines in such cases.

If you keep your petition pending here, nothing will happen for ten years. If you at least file a suit, you will get some immediate relief,” the bench remarked during the hearing.

The petitioner’s counsel explained that his client has already suffered significant, irreversible harm and now lives with a 100% disability in his lower limbs. The petition urges the court and the vaccine manufacturer, Serum Institute of India, to take responsibility and ensure that the petitioner is able to live a life of dignity despite his condition.
