Broken Stent Stuck In Pancreatic Duct! Hospital Told to Pay Rs 25 Lakh Compensation

The District Consumer Disputes Redressal Commission (DCDRC) in Chandigarh has ordered Mukat Hospital to pay ₹25 lakh as compensation to a patient for medical negligence during a gallbladder surgery. An additional ₹6.37 lakh must be paid for treatment costs incurred at Medanta Hospital, along with ₹10,000 for litigation expenses.

The case dates back to 2021, when the patient underwent laparoscopic gallbladder removal at Mukat Hospital. During the surgery, a pancreatic duct (PD) stent broke and a fragment got stuck inside the pancreatic duct. The hospital failed to inform the patient’s family and unsuccessfully attempted to manage the situation, eventually referring her to Medanta Hospital, Gurugram.

At Medanta, multiple procedures were required to remove the broken stent fragments and treat bile leakage caused by improper surgical clipping. The patient had to be admitted three times, spending over ₹6 lakh.

The Commission held that Mukat Hospital was not equipped to handle such complications and used a substandard stent, putting the patient’s life at risk. Citing deficiency in service and medical negligence, the court concluded that the hospital must be held accountable.
