Foreign Medical Graduate Candidates Must Have Entitled Integrated Degrees: Delhi HC

The Delhi High Court has validated the National Medical Commission (NMC) policy concerning foreign medical graduate applicants which mandates obtaining an appropriate integrated medical degree to meet qualification criteria for sitting in the Foreign Medical Graduate Examination (FMGE). No combination of medical education from different countries can be considered as equivalent to attending a single full-fledged medical program.

Court Dismisses Plea About Divided Medical Education


The court’s decision was made during consideration of the petition filed by the medical graduate who had passed the various segments of medical education at different medical education institutions in different countries.

The court pointed out that the disaggregated qualification cannot be considered to meet the requirement of the NMC rules.

NMC Regulations Relate to Foreign Medical Graduate Applicants


The High Court highlighted that achieving the necessary number of educational qualifications alone is not enough if the acquired qualifications do not comply with the NMC regulations.

It must be noted that the mere fact that one has completed segments of a medical programme in various places, or in nations, does not qualify one to take the FMGE.

The ruling states that there are mandatory requirements set forth by the NMC’s Foreign Medical Graduate Licentiate (FMGL) Regulations, 2021.

Petition for Indian Students who are Studying Abroad

From the ruling, it is evident that Indian students who are planning to take medical courses abroad must confirm their programme’s recognition and credibility before taking admission.

It is crucial for students to ensure that their medical programme, internship and clinical training follow the NMC’s requirements. Otherwise, they may find it difficult to qualify for FMGE.

Interpretation of the Ruling

The judgment reinforces the belief that foreign medical studies must conform to the particularised standards set by the NMC. Students should not think that the completion of several independent parts of medical study will make them eligible for the FMGE.
